In this data protection notice, LUX Automation GmbH, Am Trippelsberg 45, 40589 Düsseldorf, Datenschutz@lux-automation.com (hereinafter referred to as “we“, “us” or “LUX Automation GmbH“) would like to inform you about how we, as the responsible party in the sense of data protection law, process personal data about you during your visit to our website https://www.lux-automation.com.

 

1. What personal data do we collect from you?

Personal data is any information about an identified or identifiable natural person that you provide to us or that arises from or is collected by us. In relation to our website, this includes in particular:

Inquiry data: On our website, we offer you various options for contacting us via enquiries. If you use the contact form provided for this purpose, data will be entered by you or collected about you in this context. This occurs in particular in the following cases:

– If you send us a general or specific enquiry via the contact form or e-mail addresses designated on our website, we will process the data provided therein in order to process your enquiry.

– If you subscribe to our newsletter via the designated form, we will process your email address in order to send you the newsletter, provided that you have expressly consented to our newsletter being sent to the email address you have provided.

Use data: We create use profiles under a pseudonym with regard to your use of our website, with the help of which we can understand how our website is used.

Server log data: When you use our websites, data about this (such as the date and time of your visit, pages accessed and files requested, the type and version of the web browser you are using, the type and operating system of the terminal device you are using and your IP address) is temporarily stored in a log file on our servers.

Applicant data: Information regarding the collection of personal data in the context of applications via our “Careers” portal can be found there in separate data protection notices.

 

2. For what, on what legal basis and for how long do we process your personal data?

2.1 Your enquiries

If you send us enquiries via a contact form or by e-mail, we process the information you provide therein in order to respond to your enquiry, as well as the IP address and date/time of the enquiry to prevent misuse of the contact form.

The legal basis for the processing is our legitimate interest according to Art. 6 (1) lit. f DSGVO to provide you with the requested service (e.g. supplier portal, TECademy, contact request). If your request is aimed at the initiation or execution (including customer service or warranty) of a contract, the additional legal basis for the processing is Art. 6 (1) lit. b DSGVO.

You may object to the processing of your data on the basis of Art. 6 (1) lit. f DSGVO. We can then continue processing if we can prove compelling reasons for the processing. In this case, this may be necessary in particular to be able to prove past communication and enquiries with you. If there are no such compelling reasons, we will stop communicating with you and delete any data already collected.

This data will be deleted when our communication with you or the connection with you resulting from your enquiry has ended, i.e. when the facts concerned have been conclusively clarified and there are no further legitimate interests in storing it or there are no further legal obligations to store it.

2.2 Applications

Applicant data: Information regarding the collection of personal data in the context of applications via our “Careers” portal can be found there in separate data protection notices.

2.3 Advertising and product development (usage data, newsletters, etc.), right to object

We would also like to use the data you enter or accumulate anyway when using our websites to inform you about our products and services related to our product range (“Services“) (advertising) or to improve our offers and services (product development).

2.3.1 Anonymised usage data

We use anonymised or aggregated data obtained with the help of analysis tools to track the surfing behaviour of all visitors and thus to improve the design of our website and our product range in general. For details on the analysis tools, see section 4 below.

2.3.2 Personalised or pseudonymised usage data

We also use your usage data to track your surfing behaviour and thus to improve the offer displayed to you or to display information tailored to you.

2.3.3 Direct marketing

You can subscribe to a free newsletter on our website. In doing so, the data collected during registration will be processed (the data displayed as mandatory fields are mandatory for receipt; data marked as voluntary are only used for a more personal approach and selection of the information displayed).

By telephone, we will only contact you with information, offers and special offers on services tailored to you and your interests or use with your express consent.

You may at any time object in whole or in part to the creation of pseudonymised data, the use of your personal data for advertising and product development purposes and the contacting of you via a specific form for this purpose, or revoke any consent you may have given. Please use the corresponding functions provided for you (e.g. the unsubscribe function in your personal customer account) or send a corresponding message in writing (keyword: data protection) or by e-mail to the contact details given in section 8.

The legal basis for the processing is your consent (Art. 6 (1) lit. a DSGVO) and our legitimate interests (Art. 6 (1) lit. f DSGVO), if applicable in conjunction with Section 7 (3) UWG.

This data will be deleted or only stored in aggregated, anonymised form after your objection or the revocation of any consent given or otherwise at the latest after we have ceased to use it. Where necessary, we will store the fact of your objection in order to prevent you from being contacted further.

2.4 For the provision of the website and services

The processing of server log data is necessary to provide the websites and to provide the services for technical reasons and thereafter to ensure system security.

The legal basis for the processing is our legitimate interest in providing the website with our services (Art. 6 (1) lit. f DSGVO). The processing is mandatory for the use of our website, so there is no right to object.

This data is deleted after 14 days at the latest.

The server log data may then be evaluated anonymously for statistical purposes and to improve the quality of our website. The server log data will not be linked to your personal data or merged with other personal data sources.

 

3. Disclosure of data

3.1 Transfer of data to order processors

In some cases, we use service providers in compliance with the legal requirements by way of commissioned processing, i.e. on the basis of a contract on our behalf, in accordance with our instructions and under our control.

Processors are in particular

– technical service providers that we use to provide the website, e.g. service providers for software maintenance, data centre operation and hosting or printing of materials.

– Technical service providers that we use to provide functionalities, e.g. technically necessary cookies.

– Service providers for the practical implementation of advertising and marketing, e.g. service providers for email dispatch, online surveys and analysis cookies.

In these cases, we remain responsible for the data processing; the transfer and processing of personal data to or by our processors is based on the legal basis that allows us to process the data in each case. A separate legal basis is not required.

3.2 Data transfer to third parties

In some cases, we also transfer your data to third parties, i.e. partners with whom we cooperate outside of commissioned processing. Such partners provide their services as their own data controllers; the processing of your data by partners is governed exclusively by their data protection notices.

3.3 Data transmission to other group companies of SMS group GmbH

Where applicable, we will transfer your enquiry and the data you have provided to the relevant SMS group subsidiaries in Germany and other countries if this is necessary to respond to your enquiry (e.g. because your enquiry relates to a business transaction or a price offer from another country). The legal basis for the transfer is the provision of the service you have requested, Art. 6 (1) lit. b DSGVO or our legitimate interest to process your request, Art. 6 (1) lit. f DSGVO.

Please note that, depending on the nature of your request, this may also mean transferring your personal data to countries outside the European Economic Area, which do not necessarily offer the same level of data protection. By signing EU standard contractual clauses (Art. 46 (2) DSGVO), we ensure adequate protection of your data in these cases; you can obtain a copy of the relevant contractual clauses via the contact address mentioned in section 8.

 

4. Cookies and web analytics

4.1 What are cookies?

In order to make our websites as user-friendly as possible and to increase the relevance of our advertising for visitors to our websites, we and our partners use so-called “cookies”. Cookies are small files that are stored on a visitor’s hard drive. They allow us to retain information for a certain period of time and to identify the visitor’s computer. This is sometimes done using so-called tracking pixels, which are not stored on a visitor’s hard drive, but which can help to identify the computer in the same way as a cookie. In the following, the term “cookie” includes both cookies in the technical sense and tracking pixels and similar technical methods.

4.2 Which cookies do we use, on what legal basis and for how long?

We use three categories of cookies on our websites: (1) technically necessary cookies, without which the functionality of our websites would be limited, (2) optional analysis cookies and (3) optional targeting or advertising cookies:

4.2.1 Technically necessary cookies

These cookies are essential to enable you to navigate our websites and use their features. For example, they store your language preferences, your log-in or they allow you to easily find retailers where you can purchase our products (e.g. by displaying a map of your area). These cookies do not collect information about you to be used for marketing purposes or to remember where you have been on the internet. Disabling this category of cookies would limit the functionality of the websites as a whole or parts of it.

The legal basis for the processing is our legitimate interests (Art. 6 (1) lit. f DSGVO).

These cookies are session-specific and expire after your visit to the website (session).

4.2.2 Analysis cookies / Google Analytics

Analytics cookies collect information about how visitors use a website overall, for example, which pages they visit most often and whether they receive error messages from websites. These cookies do not collect data that can identify visitors. Any information collected using these cookies is used solely to help us understand and improve the functionality and service of the website.

We use Google Analytics, a web analytics service provided by Google, Inc. to analyse our website. The information generated by the use of Google Analytics about your use of this website will be transmitted to and stored by Google on servers in the United States. However, by activating IP anonymisation on this website, your IP address will be truncated beforehand by Google within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by the user’s browser will not be merged with any other data held by Google.

Google will use this information on our behalf for the purpose of evaluating your use of our website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. In doing so, pseudonymous user profiles of the users can be created from the processed data.

Users can prevent the storage of cookies by setting their browser software accordingly; users can also prevent the collection of the data generated by the cookie and related to their use of the online offer to Google as well as the processing of this data by Google by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

The legal basis for the processing is our legitimate interests because we only use pseudonymised or anonymised data (Art. 6 (1) lit. f DSGVO).

The data collected on the basis of these cookies is anonymised before analysis. Cookies and the information stored in them can be deactivated or deleted by you at any time (see 4.3).

4.2.3 Targeting and advertising cookies

Targeting and advertising cookies are used to target advertising more specifically to you and your interests. They are also used to limit how often you see the same ad, measure the effectiveness of an advertising campaign and understand people’s behaviour after viewing an ad. These cookies are usually placed by advertising networks on their sites with the consent of the website operator (i.e. us in this case). They recognise that a user has visited a website and pass this information on to others, e.g. advertising companies, or adapt advertisements themselves accordingly. They are often linked to website functionality provided by that company. We therefore also use these cookies to link to social networks, which can then further use the information about your visit to target advertising to you on other websites, and to provide information about your visit to the advertising networks we use, so that you can later be presented with exactly the advertising that you are potentially really interested in, based on your browsing behaviour.

The legal basis for the processing is your consent in the context of the cookie banner displayed when you reach our website (Art. 6 (1) lit. a DSGVO).

Cookies and the information stored in them can be deactivated or deleted by you at any time (cf. 4.3).

4.2.4 Deactivation of analysis, targeting and advertising cookies

The deactivation of these categories of analysis, targeting and advertising cookies does not affect the functionalities of our websites. 6. Security

We and our service providers take technical and organisational security measures to protect your personal data managed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorised persons. Our data processing and security measures are continuously improved in line with technological developments.

When your personal data is transmitted to us, it is encrypted using Secure Socket Layer (SSL). Personal data that is exchanged between you and us or other companies involved is always transmitted via encrypted connections that comply with the current state of the art.

Our employees and our contracted service providers are of course committed to confidentiality.

 

7. Your rights to information, correction, blocking or deletion

Every natural person whose personal data we process is generally (i.e. depending on the respective conditions) entitled to the following rights vis-à-vis us:

– If you have questions about the processing of your personal data by us, we will be happy to provide you with information about the data stored about you free of charge at any time (Art. 15 DSGVO).

– You have the right to correct incorrect and complete incomplete data (Art. 16 DSGVO).

– You have a right to block/restrict the processing or erasure of your personal data no longer needed or stored due to legal obligations (Ar.t 17, 18 DSGVO).

– You have a right to have the data transferred in a structured, common and machine-readable format if you have provided us with the data on the basis of consent or on the basis of a contract between us and you (Art. 20 DSGVO).

– You have the right to object at any time to the processing of your data for direct marketing purposes (see also section 2.4, Art. 21 (2) and (3) DSGVO)).

– You have a right to object on the basis of processing based on legitimate interest, in which case we can demonstrate our compelling reasons (Art. 21(1) DSGVO). We have indicated above (see point 2) when this right exists.

– If you have given your consent to data processing, you can revoke this at any time with effect for the future, i.e. the lawfulness of the data processing up to the time of revocation remains unaffected. After revoking your consent, you may no longer be able to use our services.

Please send your request in writing (keyword: data protection) or by e-mail to the contact details given under point 8. We reserve the right to check your identity so that your personal data does not become known to unauthorised persons.

You also have the right to lodge a complaint with a supervisory authority for data protection.
